What to do if your tenant will not vacate the property

You need to take professional or legal advice immediately. If your property is fully managed by a letting agency they should be able to provide guidance. If you are a Home & Legacy policyholder with legal expenses cover you will also have access to a free legal care helpline, Lawcare. This service is available 24 hours a day 7 days a week and provides free advice on what to do in a dispute with a tenant and other tenancy related matters. 

If you have legal expenses cover you may be able to pursue a claim under your policy. You should also report the circumstances to our claims helpline by calling 0844 893 8360 and selecting ‘Option 4’.  It is very important that you tell us about any problems immediately you become aware of them as you must notify us within 30 days otherwise the insurer may not accept your claim.

We will ask you to complete a claims form and provide us with:

  • A copy of the tenancy agreement
  • A copy of the schedule of rent detailing any rental arrears
  • Copies of all tenant references (and guarantor references if applicable) obtained at the start of the tenancy
  • Copies of any correspondence that you or your agent have had with the tenant about the dispute
